Trek10, Inc. (“Trek10”) is committed to protecting your privacy. We will only use the information that we collect about you lawfully and to create and administer accounts and provide services. Trek10 is an Indiana corporation with its principal place of business at 1400 E Angela Blvd, Suite 209, South Bend, Indiana 46617.

I. Personal Information We Collect

A. When you fill out a contact form at Trek10.com or other Trek10 owned web properties, you provide:

  1. your first and last name,
  2. your email address,
  3. your phone number (optional),
  4. your company,
  5. and other additional voluntary information submitted in the “How can we help?” online form,
  6. a username and password (if using Client Portal hereafter “Argonaut”),
  7. your IP address.

B. We also collect some of this information when you contact us for more information, such as through email, chatbots, or support requests.

C. We collect technical data and information automatically about how and when you use Trek10.com or other Trek10 owned web properties, including, for example, your IP address, time, date, browser used, and actions you have taken within the application. This information helps us to improve our services both for you and for all our users.

II. How We Use Personal Data

A. We use your personal information to provide services to you and to communicate with you:

  1. We use your email address as your username when you log in. We also use your email address to send notification emails from Trek10, including announcements about new product features and general communication.
  2. We use your name, username, and or email address when other users of Trek10 interact with your account, such as during training.
  3. When using Argonaut, our third party identity management service Auth0, uses your password solely to verify access to your account. It does not store your actual password, just an indecipherable representation (encrypted hash).
  4. We use your IP address to help prevent fraud or abuse of our service.
  5. We use your billing information solely to communicate with you about your paid subscription and charge your credit card for services. Trek10 does not capture, process, store or transmit credit card information. A third-party payment processor handles all interactions with credit card information on our behalf.
  6. We use personal information for auditing, research and analysis to operate and improve Trek10. We may use certain other information collected from you to help diagnose technical problems, administer Trek10, and improve the quality and types of services delivered.

B. Cookies

  1. We use cookies to assist in delivering the services and to provide a positive and personalized user experience. Our cookies are used to identify unique visitors to Trek10 and to provide you with easy access to the services when you log in. If you have your browser set to reject cookies, you will not be able to log into Trek10.
  2. There are a number of different types of cookies, however, our website uses:

a. Functionality

i. Trek10 uses these cookies so that we recognize you on our website and remember your previously selected preferences. A mix of first-party and third-party cookies are used.

b. Advertising

i. Trek10 uses these cookies to collect information about your visit to our website, the content you viewed, the links you followed and information about your browser, device, and your IP address.

III. Reasons We Share Personal Data

A. We share information with authorized third parties to provide services, never for resale or unlawful purposes.

B. Personal information we gather is for internal use only and we will not authorize the release of this information to anyone outside Trek10, except as clearly described below.

C. We may release the information we collect to authorized third parties so they can perform functions on our behalf and on behalf of you, our customer. These third parties have agreed to use at least the same level of privacy protections described in this Privacy Policy and are permitted to use the information only for the purpose of performing these functions.

D. Should you breach our Terms and Conditions, or if we are under a duty to disclose or share your personal data in order to comply with any legal obligations, we may disclose your information to a relevant authority. This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. Specifically, we may release the information we collect to third parties when we believe it is appropriate to comply with the law, to enforce our legal rights, to protect the rights and safety of others, or to assist with industry efforts to control fraud, spam or other undesirable conduct.

IV. How to Access & Control Your Personal Data

A. You can contact us via privacy@trek10.com to determine what personal information we have stored about you.

B. If email marketing services are utilized, you can opt out by clicking the unsubscribe link at the bottom of each email.

C. If utilizing Argonaut, you can easily access or modify your personal information in Trek10 at any time:

  1. You can access and modify your personal information by logging into Argonaut using your email address and password.
  2. If you have forgotten your password, you can reset your password.
  3. When you change your personal information, we make every effort to update this information in all of our systems. However, some historical data, like previous support requests you submitted, may reflect the information provided at the time the information was initially recorded. This historical data will not affect your future use of Trek10 or new communications with us. After deleting your account, your organization, forms and entries will no longer be accessible or recoverable, and you will no longer receive notifications from Trek10 about your account.

D. You can opt out or remove your personal information from Trek10 at any time:

  1. You can also permanently delete your user account by contacting privacy@trek10.com. This will delete both your user account and all organizations for which you are the sole organization owner.
  2. Opting out of receiving marketing emails will not affect your ability to use Trek10. Conversely, deleting your account will not affect your ability to receive marketing emails and become aware of future product features you may be interested in.

V. Public Information and Third-Party Websites

A. Our privacy policy does not apply to websites we link to, just ours.

B. Information we collect from you is not shared publicly.

C. Trek10 includes links to other websites whose privacy practices may be different from ours. If you submit personal information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.

D. Authorized Third Parties

  1. We use a number of authorized third parties to provide form building services. They are not permitted to use information we share with them for any other purpose.
  2. We use third parties to assist us in processing your personal information, and these third parties have their own Privacy Policy and appropriate confidentiality and security measures.

a. Hosting

b. Authentication

d. Employees of Business Customers

i. If you are an employee of one of our business customers, we will share information generated from your use of Services with your employer, such as courses taken, account usage and course results.

3. How We Share Personal Information with Third Parties - We partner with and occasionally hire other companies to provide services on our behalf. Personal Information may be shared with these companies, vendors, consultants and other service providers who work for us and need access to your Personal Information to do that work; however, we will only share your Personal Information to accomplish the purposes for which we collected the Personal Information. These third parties are contractually required to maintain the confidentiality of your Personal Information and are contractually prohibited from using that information for any other purpose and from selling your Personal Information.

a. We may also share your information as follows:

i. with your consent;
ii. when we believe in good faith that disclosure is necessary to protect our rights or property;
iii. to protect your safety or the safety of others;
iv. to investigate fraud or respond to a government, judicial or other legal request;

  1. We work hard to keep your information safe and secure.
  2. We take reasonable and appropriate measures to protect personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the personal information.
  3. If applicable, Trek10 accounts require an email address and password to log in. You must keep your email address and password secure, and never disclose it to a third party. If you feel like the security of your account has been compromised, you must inform us immediately so we can take protective measures to safeguard your information.

VII. Compliance and User Rights

A. Trek10 operates in the United States and its servers and data are securely stored in datacenters in the United States. By using Trek10.com, you understand and consent to the collection, storage, processing, and transfer of your information as described herein to our facilities in the United States and to those third parties with whom we share it as described in this policy.

B. Data Transfers from Europe to the United States

  1. It is Trek10’s intent to meet the privacy adequacy provisions of the EU General Data Protection Regulation (“GDPR”).

C. California Residents

  1. We comply with the California Consumer Protection Act.
  2. Trek10 complies with the provisions of the California Consumer Protection Act, which grants specific data privacy rights to California residents.
  3. As stated in this privacy policy Trek10 collects minimal amounts of personal information, uses this information solely to provide form building services, does not sell your personal information, and allows you to update or remove this information at any time.

VIII. Data Protection Rights

A. Trek10 would like to make sure you are fully aware of all of your data protection rights.

B. Every user is entitled to the following:

  1. The right to access - You have the right to request copies of your personal data. We may charge you a small fee for this service.
  2. The right to rectification - You have the right to request that Trek10 correct any information you believe is inaccurate. You also have the right to request Trek10 to complete information you believe is incomplete.
  3. The right to erasure - You have the right to request that Trek10 erase your personal data, under certain conditions.
  4. The right to restrict processing - You have the right to request that Trek10 restrict the processing of your personal data, under certain conditions.
  5. The right to object to processing - You have the right to object to Trek10’s processing of your personal data, under certain conditions.
  6. The right to data portability - You have the right to request that Trek10 transfer the data that we have collected to another organization, or directly to you, under certain conditions.

IX. Data Retention

A. Deleted information may be retained in backups, but if you delete your organization, your forms and entries will be permanently deleted.

B. We do our best to keep your data accurate and up to date, to the extent that you provide us with the information we need to do so. If your data changes (for example, if you have a new email address), then you are responsible for logging into your account and updating this information, as this is the only way we can verify your identity given the limited amount of personal information we collect.

C. We will retain your information for as long as your account is active or as long as your information is necessary to provide you with our services. We may also retain and use your information to comply with our legal obligations, resolve disputes, prevent abuse, and enforce our agreements.

X. Scope

A. This Privacy Policy applies to your use of Trek10.com and other Trek10 owned web properties.

B. Changes

  1. We may update this Privacy Policy from time to time at our sole discretion.
  2. We may change this Privacy Policy at any time and from time to time. The most recent version of the Privacy Policy is reflected by the modification date located at the bottom. All updates and amendments are effective immediately upon notice, which we may give by any means, including, but not limited to, by posting a revised version of this Privacy Policy or other notice on Trek10.com and other Trek10 owned web properties.
